Darling Stylist Competition Terms and Conditions

Please read these Terms and Conditions carefully. Participation in this Challenge will constitute your agreement to comply with these Terms and Conditions. If you do not agree with these Terms and Conditions, please do not participate. Darling Hair under Subinite Pty Ltd (“The Promotor”) situated at 680 Joseph Lister Street and Constantia Boulevard, Constantia Kloof, Roodepoort hereafter referred to as “the Promoter”, will run the “Darling Holiday Hair Hype” hereafter referred to as “the Challenge”. Please contact Darling Team during working hours between 08:00 -17:00 on +27 878078400 or via Facebook at Darling Style Superstars (ZA) or Darling South Africa should you have any questions regarding the challenge.

CHALLENGE PERIOD:
1. The Promotion will run from 13th December 2024 – 31 December (“the Challenge Period”).
2. No entries received after midnight on the 31 December 2024 will be accepted.
3. The duration of the Challenge may be extended or curtailed at the discretion of the Promoter.
WHO MAY ENTER:
1. All Participants must:
  1. Be a natural person and be 18 (eighteen) years of age at the date of the entry.
  2. Be a citizen of the Republic of South Africa and/or a legal resident of the country.
  3. Be in possession of a valid South African Identity Document or valid residency documentation (i.e. permanent resident permit).
2. Participation in this Challenge excludes directors, members, partners, promotional and advertising agents, merchandisers, employees or consultants of the Promoter, their Agencies, organisers and participating stores, of the Challenge and the spouse, life partner, parent, child, brother, sister, business partner or associate of any of the said persons.

  Submit your best holiday hair inspirations.
  Selected entries will feature in the Darling Holiday Lookbook every Friday on our social media channels
  One stylist will win cash prize every week.
2. If a potential prize winner does not meet the eligibility requirements, the prize will be forfeited and a runner up finalist will be deemed the potential prize winner subject to the terms and conditions herein. For the avoidance of doubt, in the event that a potential winner is announced and it is subsequently discovered that the potential winner has not met all the eligibility requirements, the prize can be retracted at no liability to the Promoter and its agent representative.
3. The winners will be announced after the competition period has ended. Participants can only win prizes once-off for the remainder of the challenge. Winners will be determined by a panel of judges internally that will be held after the challenge period and will be overseen by an external auditor as per the Consumer Protection Act 68 of 2008, regulation 11(5).
THE PRIZE:
Participants in this Challenge stand a chance to win once-off one of the following during the challenge period:
1. Two winners will receive a gift voucher to the value of R5 000 (“Five Thousand Rand ”) this will be awarded to them after the challenge period.
CLAIM YOUR PRIZE
1. At the time that a potential prize winner is identified after the closing date. The potential prize winner will receive a direct message on their social media pages and/or cellphone number at which point he/she may be required to answer a few questions regarding his/her eligibility as well as be requested to submit certain documents such a copy of his/her ID and/or driver’s license to the Promoters representative).
2. If the Promotors are unable to reach any of the potential prize winners after 3 (three) attempts made within 3 (three) working days of their name being drawn, for whatsoever reason, including direct messages on their participating Facebook page, such winner will be disqualified and a runner up finalist will be deemed the potential prize winner subject to the terms and conditions herein.
3. Prizes are not transferrable.
4. The potential prize winner is not an actual winner until his/her submission is validated and his/her documents are completed and submitted to the Promotors. If a potential prize winner does not meet the eligibility requirements, the prize will be forfeited and a runner up finalist will be deemed the potential prize winner subject to the terms and conditions herein.
5. The Promoter reserves the right to retract any statement in which it mistakenly notifies a qualifying Participant that he or she is a prize winner.
INDEMNITY
1. To the extent permitted by the Consumer Protection Act and any other applicable law:
  1. The participant and/or winner(s) hereby indemnifies the Promoter, its associated companies (directors, officers and employees) and agents against any direct, indirect, special, incidental, consequential or punitive damages or loss of any kind regardless of how this was caused, and whether it arose under the law of contract or delict or otherwise, because of the participants’ entrance to the Challenge.
  2. The Promoter excludes all warranties (express or implied), representations and liabilities regarding this Challenge (other than for death or personal injury caused by its gross negligence and/or fraud).
2. The Promoter reserves the right, at any time, to verify the validity of participants (including but not limited to a participant’s identity, age and place of residence) and to reject any participant who has not complied with these Terms and Conditions. Errors and omission may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
3. Neither Promoter nor its agents or distributors will have any liability in relation to this Challenge.
CONFIDENTIALITY
1. Participants of this Challenge are voluntarily providing their personal information to the Promoter, its associated agencies and the third party service providers running the Challenge in conjunction with the Promoter. By entering this challenge, participants authorise the Promoter to collect, store and use (not share) personal information of participants for communication or statistical purposes. Participants are entitled to decline any marketing communication and inform the Promoter in writing should the participant wish to be removed from all communication.
2. By entering this challenge, the participant consents that the Promoter may use names, images and videos taken of the winners/participants for publicity purposes, without any further remuneration being payable to the winners/participants. All entry material will become the sole property of the Promoter. However, the participant/winner has the right to decline participating in any promotional activity or to object to these images being used by written notification to the Promoter at 680 Joseph Lister Street and Constantia Boulevard Street, Constantia Kloof, Roodepoort Attention: Legal Department. The written notification is to reach the Promoter by no later than the stipulated draw date.
GENERAL
1. The Promoter reserves the right to amend, modify, change, postpone, suspend or cancel this Challenge and any prizes, or any aspect thereof, without notice at any time, for any reason that the Promoter reasonably deems necessary.
2. The onus rests on the participants to check Facebook for updates to the Terms and Conditions.
3. The Promoters may require the winner to complete and submit an information disclosure agreement to enable the Promoters to ensure compliance with these Rules. Should the winner be found not to have complied with these Rules, he/she will automatically be disqualified, and the prize will be forfeited. Winners may also be required to sign acceptance of prizes and indemnity documents.
4. By entering this Challenge, you authorise the Promoters to collect, store and use (not share) personal information of Participants for communication or statistical purposes.
5. Any personal data submitted by you will be used solely in accordance with current South African data protection legislation (The Protection of Personal Information Act, 4, 2013 “POPIA”) and the Promoters privacy policy.
6. No liability shall lie on the Promoter in favour of any participant, winner (s) and/or third party arising from such cancellation, suspension or termination. Therefore, the participant waives his/her right which they may have against the Promoter and hereby acknowledges that they will have no right of recourse or claim of any nature whatsoever against the Promoter.
7. The Promoters decision is final, and no correspondence will be entered into.
8. This promotion is in no way sponsored, endorsed or administered by or associated with Facebook.
9. In part or all of any clause of these Terms and Conditions is illegal, invalid or enforceable:
  1. It will be read down to the extent necessary to ensure that it is not illegal, invalid or unenforceable, but if that is not possible;
  2. It will be severed from these Terms and Conditions and the remaining provisions of these Terms and Conditions will continue to have full force and effect.
10. Any dispute with number ownership (such as more than one individual claiming to be the owner of the same number – verbally or otherwise) will result in immediate disqualification of both the number and the individuals and no negotiations will be entered into.
11. The promoter reserves the sole right to disqualify without notice any entries that engages in purchasing votes or acquiring votes through any false medium. Such entries will be automatically deleted.
12. The promoter reserves the sole right to disqualify any entries that contain profanity, sexual content, abusive language or any other offensive content.

The promoter reserves the right to cancel this challenge at any time and is not liable to provide notice thereof.
